What is Overtime Pay?
Overtime pay is additional compensation for employees working beyond the standard eight hours per day or 48 hours per week, as mandated by the Philippine Labor Code (Presidential Decree No. 442).
It ensures fair compensation for extra effort, calculated using the employee’s regular wage rate with specific multipliers based on the type of day and whether the work occurs during a night shift.
Overtime is generally voluntary, except in emergencies like national crises or urgent operational needs.
Who is Eligible for Overtime Pay in the Philippines
Most regular employees are entitled to overtime pay, except for:
- Managerial employees
- Field personnel
- Employees of retail/service establishments with fewer than 10 workers
- Government employees and those in government-owned corporations
- Family members dependent on the employer
- Domestic helpers and personal service workers
- Workers paid by results (e.g., piece-rate workers)
Overtime Pay Rates
Overtime pay rates in the Philippines depend on the type of day and whether a night shift differential applies.
The table below outlines the multipliers and example rates based on an hourly wage of ₱60.00 (derived from a ₱480.00 daily wage ÷ 8 hours):
Scenario | Multiplier | Example (Hourly Rate: ₱60.00) | Overtime Rate/Hour |
---|---|---|---|
Ordinary Day Overtime | 1.25 | ₱60.00 x 1.25 | ₱75.00 |
Rest Day or Special Holiday | 1.69 | ₱60.00 x 1.69 | ₱101.40 |
Special Holiday and Rest Day | 1.95 | ₱60.00 x 1.95 | ₱117.00 |
Regular Holiday | 2.60 | ₱60.00 x 2.60 | ₱156.00 |
Regular Holiday and Rest Day | 3.38 | ₱60.00 x 3.38 | ₱202.80 |
Double Holiday | 3.90 | ₱60.00 x 3.90 | ₱234.00 |
Double Holiday and Rest Day | 5.07 | ₱60.00 x 5.07 | ₱304.20 |
Night Shift Differential
Employees working between 10:00 PM and 6:00 AM receive an additional 10% of their regular hourly rate as a night shift differential, applied to both regular and overtime hours worked during this period.
Example Calculation
Consider an employee with a daily wage of ₱800.00 working 2 hours of overtime on an ordinary working day, with no night shift:
- Hourly rate: ₱800.00 ÷ 8 hours = ₱100.00/hour
- Overtime hourly rate: ₱100.00 x 1.25 = ₱125.00/hour
- Overtime pay: ₱125.00 x 2 hours = ₱250.00
- Total day’s wage: ₱250.00 (overtime) + ₱800.00 (regular 8 hours) = ₱1,050.00
If the same overtime occurs during a night shift:
- Night shift differential: ₱100.00 x 0.10 x 2 hours = ₱20.00
- Total overtime pay: ₱250.00 + ₱20.00 = ₱270.00
- Total day’s wage: ₱270.00 + ₱800.00 + (₱100.00 x 0.10 x 8 hours) = ₱1,150.00
Important Notes
- Night Shift Assumption: If the "Night Shift" option is selected, the calculator assumes all hours (regular and overtime) are worked between 10:00 PM and 6:00 AM, applying the 10% differential.
- Voluntary Overtime: Overtime is generally voluntary unless required during emergencies (e.g., national crises, urgent repairs). Employees may request overtime, but approval depends on business needs.
- Accuracy: This calculator provides estimates. For official calculations, consult your HR department or DOLE.
- Record-Keeping: Employers must maintain accurate records of work hours to comply with labor laws.
